Labor Code: new amendments strengthening the principle of equal pay for men and women
On June 4, 2025, a law was passed amending the Polish Labor Code. These amendments are intended to partially implement into Polish law Directive (EU) 2023/970 of the European Parliament and of the Council of 10 May 2023, which aims to strengthen the principle of equal pay for men and women performing the same work or work of equal value – through pay transparency and enforcement mechanisms.
Below, we present the key points connected with the upcoming changes:
New employer obligations
- Informational transparency for job applicants
Every employer will be required to provide candidates with clear information about:
the salary amount, its starting value, or pay range for the position (e.g., salary bands),
relevant provisions of the collective labor agreement or internal pay regulations (if applicable).
This information must be shared sufficiently in advance so that the candidate can review it:
- in the job posting,
- before the interview (if there was no posting or the information was missing), or, at the latest, before signing the employment contract (if not provided earlier).
It can be provided either on paper or electronically.
- Gender-neutral job ads and recruitment
Employers will be obligated to ensure that job postings and job titles are gender-neutral and that recruitment processes are conducted in a non-discriminatory manner.
- Prohibition on requesting past or current salary details from candidates
Employers will no longer be allowed to request past or current salary details from candidates.
When will these changes take effect?
The new regulations will take effect on December 24, 2025.
